The sticker on my OEM battery is matte black, while this one arrived as glossy (and not as well applied). The battery contacts are exposed through slightly arched cutouts on the OEM, and on this battery they are squared. Plus the fit of the OEM is perfect, while this battery is a little snug. It fits, but I had to use more pressure to get it into my phone.
So is it counterfeit? I don't really have a way to know for sure, but I'd say that's a good possibility. That or HTC really changed their manufacturing process (and lowered their standards) between when I bought my phone 3 months ago and when I bought this second battery.
It's important to note that despite the snug fit and cosmetic flaws, this battery does work. I only just got it, but it is powered up and working in my phone just fine. I don't have time to do any scientific tests on the battery life, but if I notice that this second battery has a greatly decreased output against my true OEM battery, I'll update this review.
11/2010 UPDATE
This battery probably gives me 60-70% of the juice that I get from my actual OEM battery (the one that came with my phone). So it's not a total dud, and I keep it in my bag as a 2nd backup for traveling. My new 1st backup is a Seido branded battery that gives me output much closer to my OEM.
